Contest Rules

VIA Rail Canada Inc. is the Contest Holder for the "VIA Rail Canada getaway!" contest.

Conditions for entering

The contest is open to any Canadian resident who subscribes to at least one VIA Rail e-letter and who is 18 years of age or more at the time he/she enters this contest.

By entering, all eligible contestants are deemed to have accepted all the general conditions and rules stated herein.

For its part, VIA Rail Canada Inc. agrees to adhere to said rules and general conditions. All decisions by contest officials are final.

In addition to providing their full name, street address, and valid e-mail address and telephone number, the contestant must answer the three (3) questions on the Web entry form. Their answers will be checked and must be correct for the contestant to be declared a winner. Therefore entries with a wrong answer will be disqualified and not entitled to any prize.

Contest period

The contest ends at 11:59 p.m. (ET) on Saturday, April 24, 2010.

How to enter

Contestants must subscribe to at least one VIA Rail e-letter.

Contestants must fill out and submit the entry form published on the contest web page before 11:59 p.m. (ET) on Saturday, April 24, 2010. Limit of one (1) entry per e-mail address.

Persons who are not VIA e-letter subscribers may subscribe to VIA e-letters by completing the online subscription form.

Announcement of the winner's name

The contest draw will take place at VIA Rail headquarters, located at 3 Place Ville-Marie, 5th floor, Montréal, QC, H3B 2C9 on Thursday, April 29, 2010.

The winner will be determined as follows:

  • On the day of the draw, a list of all qualifying entries will be compiled. Only one form per e-mail address will be allowed.
  • Software will then randomly shuffle the list. The person whose name appears at the top of the shuffled list will be considered the first selected contestant; the second name determines the second selected contestant, and so on.

Notification of the winner

The first selected contestant will be contacted by telephone. If there is no answer, a voice message will be left (if possible), and an e-mail will be sent to the address provided when the contestant signed up to become a VIA e-letter subscriber.

The contestant must contact the Contest Holder within 48 hours after the call (or e-mail) to claim their prize and be declared a winner. If the first selected contestant fails to contact the Contest Holder within that timeframe, they will be automatically disqualified. Then, the second selected contestant will be contacted and must meet the same conditions to be declared a winner.

This procedure will be followed with the rest of the list of selected contestants until a winner has been chosen.

Description of the prize

One (1) grand prize will be awarded. The winner will receive:

  • A $5,000 promotional travel credit redeemable for travel in the class of his/her choice to any destination on the VIA Rail network.

This prize does NOT include:

  • cost of travel to or from the origin or destination train stations;
  • parking at train stations;
  • personal expenses;
  • lodging, food and beverages (except as provided on board, as included in the chosen service class); or,
  • any other expense not outlined specifically in prize description.

The winner has one (1) year from the date of the draw to use the prize.

The prize must be accepted as is and cannot be transferred, exchanged, cashed in, or returned for a refund.

Delivery of prize

A representative appointed by VIA Rail will confirm the winner's address and the prize will be sent either by registered mail or by courier. The delivery method used will be decided upon by the representative appointed by VIA Rail and may depend on the prize itself.

The prize will be sent within seven (7) days after receipt of the release form signed by the winner (see next section.)

Rights of use and limitation of liability

Contest winners must consent to the use, if necessary, of their name and photograph for contest-related advertising purposes with no compensation.

A refusal to accept the prize releases the Contest Holder of all obligations related to the prize.

The Contest Holder assumes no liability in all instances in which its incapacity to act is the result of a situation or fact beyond its control, particularly a strike, lockout or any other labour conflict on its premises or those of its partners supplying part of the prize, if such situation or fact affects the services required for this contest.

The Contest Holder assumes no liability for lost or late entries, or mistakes on contestants' forms, misprints or any other errors.

Contest winners must sign a release form confirming their eligibility for the contest (as specified under "Eligibility" below) and relieving the Contest Holder of any liability for damages or losses resulting from entering this contest or related to award and use of the prizes.

A winner who is a minor in his/her province of residence must have his/her parent or his/her legal guardian sign a waiver or any other appropriate legal document prepared by VIA Rail and relieving the Contest Holder of any liability for damages or losses resulting from entering his contest or related to award and use of the prizes.

Eligibility

The contest is open to any Canadian resident who subscribes to at least one VIA Rail e-letter and who is 18 years of age or more at the time he/she enters this contest.

Employees, suppliers and agents of VIA Rail Canada, as well as persons residing with the above mentioned, are not entitled to enter the contest.

Entering this contest requires the disclosure of certain personal contact information by the entrant. VIA Rail is committed to ensuring the safe management of this information and will take all precautions to make certain that its use is explicitly and, wherever possible, solely and securely used for the express intention of contacting the selected entrants. Other mentions

This contest is subject to all applicable federal, provincial and municipal laws. All entries received become the property of VIA Rail Canada Inc.

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
