Contest Rules for the Québec City – Windsor corridor


VIA RAIL CANADA LUCKY SEAT CONTEST RULES
QUÉBEC CITY – WINDSOR CORRIDOR

1. The Contest is held by VIA Rail Canada Inc. (the “Contest Organizers”). The Contest runs from October 1st until October 31, 2012 inclusive (the “Contest Period”). The Contest is two-fold, i.e. there is an instant prize draw portion and a grand prize draw portion.

ELIGIBILITY

2. The Contest is open to persons 18 years old and over. Employees, agents and representatives of the Contest Organizers, of any company, corporation, trust or other legal entity controlled by or affiliated to them, of their advertising and promotional agencies, suppliers of prizes, material and services related to this Contest, of VIA Rail railway pass holders, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible.

HOW TO ENTER

No purchase necessary

3. During the Contest Period, all eligible passengers on board VIA Rail’s Quebec City – Windsor corridor trains who hold a valid boarding pass are automatically entered in the Contest and have a chance to win one of the instant prizes described hereinafter.

4. No purchase is necessary. You can enter the Contest by submitting a minimum 50-word text outlining ideas for train vacations, along with your name, address, phone number and e-mail address. Your no purchase entry request (hereafter: NPER) must be sent in no later than 5:00 p.m., October 30, 2012, during normal business hours, by e-mail to luckyseat@viarail.ca or siegechanceux@viarail.ca. Documents received after normal business hours will be treated the next business day. For the purpose of the Contest, a randomly selected car and seat number will be assigned to you for one of the trains not yet departed during the Contest Period. There is a limit of two (2) NPERs per day, per person and household, and the text provided for each NPER (train vacations ideas) must be different. No communication will be entered into with the person submitting an NPER except as provided for in section 27 of the present Contest Rules or elsewhere therein.

5. Each day and for each VIA Rail Québec City – Windsor corridor train during the Contest Period, a car and seat number will be chosen at random (hereinafter: the lucky seat) and will be used for the purpose of awarding the instant prizes. Three other such numbers will also be chosen at random as back-up numbers to be used as foreseen hereafter. If the lucky number (date, car number and seat number) matches the one on your boarding pass (for assigned seats) or matches the seat where you are legally seated (for unassigned seats) or, for NPERs, matches the number assigned to such, you are then eligible to win an instant prize and, if you are indeed declared a winner, you thereby become a finalist for the grand prize draw. In the case where the lucky number matches an occupied seat and, at the same time, matches a number assigned to an NPER, then a draw will be held to determine which of the two will be the instant prize winner and, at the same time, the finalist for the grand prize draw. Should there be no NPER and no entry made with a purchase that matches the lucky number, then the first back-up number will be used to proceed to give away the prize, and so forth. There is a limit of one instant prize per person during the entire Contest Period and, consequently, a person cannot become a finalist more than once in regards to awarding of the grand prizes.

6. In the event a train departure is cancelled or if, for security reasons or any other reasons, at the sole discretion of the Contest Organizers, no lucky number is revealed in regards to a train, then the prize relating thereto will be cancelled without notice or delay.

PRIZES TO BE WON

7. Instant prizes. There is a maximum of one thousand eight hundred and sixteen (1,816) instant prizes to be won. Each prize consists of a VIA Rail package comprised of one (1) $50 VIA Rail Canada travel credit applicable to travel anywhere and in any class on VIA Rail Canada’s rail network; and one (1) one-time entry pass to the VIA Rail Canada Toronto Union Station Panorama lounge for two (2) persons, valid until April 30, 2013. Chances of winning an instant prize are, on average, one in two hundred and fifty (1/250).

8. Grand prizes. There are sixteen (16) prizes in all.

8.1 Two (2) first grand prizes, each consisting of a return trip for two (2) persons in first class to Vancouver with VIA Rail Canada. This prize includes return transportation from the nearest station of the winner’s residence to Toronto in Business class (on-board meals included) and return transportation from Toronto to Vancouver on board the Canadian in Sleeper Plus class (on-board meals included), a total approximate value of $9,000. Exact value of prize depends on point of departure as well as time of travel. The trip must be completed between January 1, 2013 and December 31, 2013 inclusive. This prize does NOT include:

a) cost of travel to or from the origin train station;
b) parking at the train station, as the case may be;
c) lodging, food and beverages (except as provided on board, as included in the service class);
d) personal expenses; or,
e) any other expense not outlined specifically in the prize description.

The following conditions apply to the trip: No changes are permitted to reservations once they are completed and winner and guest must travel together with the same itinerary.

8.2 Two (2) second prizes, each consisting of a return trip for two (2) persons in first class to Halifax with VIA Rail Canada. This prize includes return transportation from the nearest station of the winner’s residence to Montréal in Business class (on-board meals included) and return transportation from Montréal to Halifax on board the Ocean in Sleeper or Sleeper Plus class (on- board meals included in both classes), a total approximate value of $2,700. Exact value of prize depends on point of departure as well as time of travel. The trip must be completed between January 1, 2013 and December 31, 2013 inclusive. This prize does NOT include:

a) cost of travel to or from the origin train station;
b) parking at the train station, as the case may be;
c) lodging, food and beverages (except as provided on board as included in the service class);
d) personal expenses; or,
e) any other expense not outlined specifically in the prize description.

The following conditions apply to the trip: No changes are permitted to reservations once they are completed and winner and guest must travel together with the same itinerary.

8.3 Twelve (12) third prizes, each consisting of VIA Souvenir binoculars valued at $22.

GRAND PRIZE DRAW

9. At 2 pm on November 20, 2012, in Montréal, at the office of the Contest Organizers, a random draw of sixteen (16) finalists will be made among all those declared finalists during the Contest Period. Grand prizes will be awarded in the order in which they are listed above.

10. Odds of winning. The odds of an entrant’s entry being selected depend on the number of finalists duly identified during the Contest Period.

AWARDING OF THE PRIZE

11. To be declared a winner, a selected entrant must:

11.1 Correctly answer the mathematical skill-testing question, without assistance and within a limited time, which will be asked on the train or, in the case of an NPER or a grand prize, by e–mail or during a telephone call to take place at a mutually agreed upon time;

11.2 Fill out and sign the declaration and release form (the “Declaration Form”) that the Contest Organizers will provide to him/her on the train or, in the case of an NPER or a grand prize, by mail, fax or e-mail to the effect that, among other things, he/she has fulfilled all the requirements of these Contest Rules, and return it to the Contest Organizers either directly on the train before disembarking or, in the case of an NPER or a grand prize, return it to them following the procedure mentioned on the Declaration Form so they receive it within three (3) days of its receipt;

11.3 Upon request and in a timely manner, provide a piece of identification bearing a photograph.

12. Failure to comply with one of the conditions mentioned in these Contest Rules or to accept the prize will cause the selected entrant to be disqualified. In such a case, the Contest Organizers may, at their sole discretion, cancel the prize or hold a new draw until an entrant is selected and declared a winner.

13. In cases where a potential instant prize winner is on board the train, the prize will be remitted to him/her there and then after the above requirements have all been met. In all other cases, allow one (1) week following the receipt of the duly completed and signed Declaration Form for the Contest Organizers to communicate with you in order to inform you as to the manner of claiming the prize.

14. The Contest Organizers will post the name of the grand prize winners on the VIA Rail website within fifteen (15) business days following the draw date.

GENERAL CONDITIONS

15. Verification. Documents used to enter the Contest and Declaration Forms are subject to verification by the Contest Organizers. Any document which is, as the case may be, incomplete, illegible, mutilated, fraudulent, registered or submitted late, bearing an invalid e–mail address or phone number or otherwise non-compliant, may be rejected and will not entitle to an entry or to the prize, as the case may be. In the same manner, any mistake in the answer to the mathematical skill-testing question will result in the rejection of the registration of the person concerned.

16. Disqualification. The Contest Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who participates or tries to participate in this Contest by using methods that do not comply with these Contest Rules or that are unfair to other entrants. Such a person may be reported to the appropriate legal authorities.

17. Disturbing the conduct of the Contest. Any attempt to deliberately sabotage the legitimate conduct of this Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Contest Organizers reserve the right to reject an entrant’s entry and obtain legal or equitable relief under applicable laws.

18. Acceptance of the prize. Prize must be accepted as described in these Contest Rules and may not, in any case, in whole or in part, be transferred to another person or exchanged for another prize or for cash, except as provided in the section below.

19. Substitution of the prize. In the event where it would be impossible, difficult and/or more costly for the Contest Organizers to award the prize (or a portion thereof) as described in these Contest Rules, they reserve the right to award a prize of the same kind and of equivalent value to the prize or the portion of the prize that cannot be awarded or, at their sole discretion, the cash value of the prize (or portion thereof) as indicated in these Contest Rules.

20. Liability limit: participation in the Contest. Persons who enter or try to enter this Contest release the Contest Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, their employees, agents and representatives (the “Released Parties”) from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Contest.

21. Liability limit: use of the prize. By accepting a prize, the entrant selected for the prize releases and holds harmless the Released Parties with respect to any damage resulting from the acceptance or use of the prize.

22. Liability limit: supplying of the prize. The entrant selected for the prize acknowledges that upon awarding of the prize, the obligations related to it become the responsibility of the providers of services and goods related to the prize.

23. Liability limit: conduct of the Contest. The Released Parties disclaim all liability for any of the following that may limit or prevent any entrant’s participation in the Contest or that could prevent the selection of the winner: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; and any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The Released Parties also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or other, and by the transmission of any information related to participation in the Contest.

24. Contest modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules.

25. Prize limit. In no event shall the Contest Organizers be required to award more prizes than indicated in these Contest Rules or to award a prize otherwise than in compliance with these Contest Rules.

26. Authorization. By accepting a prize, any entrant selected authorizes the Contest Organizers and their representatives to use, if required, his/her name, photo, likeness, voice, place of residence and/or statement regarding the prize for publicity purposes, without any form of compensation.

27. Communication with entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in these Contest Rules or at the Contest Organizers’ initiative. Persons submitting an NPER will only be contacted if the number assigned to their entry is found to match a lucky number.

28. Personal information. Entrants’ personal information collected for the purpose of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications.

29. Instant prize winner identification. For the purpose of these Contest Rules, the winner will be: on seat-assigned cars, the person whose name appears on the boarding pass corresponding to the lucky seat number unless that person is under 18 years of age and accompanied by a person 18 years and over in which case the prize will be remitted to the latter; on non seat-assigned cars, it will be the person who holds a valid boarding pass and legally occupies the seat corresponding to the lucky seat number at the time the VIA Rail representative approaches to award the prize unless again that person is under 18 years of age and accompanied by a person 18 years and over in which case the prize will be remitted to the latter; and in the case of an NPER, the winner will be the person identified therein.

30. Contest Organizers’ decision. Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal.

31. Litigation. Any question concerning the interpretation, validity and enforceability of the Contest Rules or of the rights and obligations of the participant and the Contest Organizers regarding the Contest will by subject to, and interpreted under, the laws of the province of Quebec, Canada. In case of litigation, such will have to be submitted to the courts in the Montreal judicial district.

32. Unenforceability. If a section of the Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

33. Language. In case of any discrepancy between the French and English versions of these Contest Rules, the French version shall prevail.

In the case where the lucky number matches an occupied seat or cabin and, at the same time, matches a number assigned to an NPER, then a draw will be held to determine which of the two will be the instant prize winner and, at the same time, the finalist for the grand prize draw. Each prize consists of a VIA Rail package comprised of one (1) $250 VIA Rail Canada travel credit applicable to travel anywhere and in any class on VIA Rail Canada’s rail network. Chances of winning an instant prize are, on average, one in two hundred and fifty (1/250).

8. Grand prizes. There are six (6) prizes in all.

8.1 Two (2) first grand prizes, each consisting of a hockey getaway return trip for two (2) persons in first class from Halifax to either Montréal, Ottawa or Toronto with VIA Rail Canada (the winner will be asked to select their choice of city from those mentioned above). The prize includes return transportation from Halifax to Montréal on board the Ocean in Sleeper class and return transportation from Montréal to Ottawa or Montréal to Toronto in Business class (meals included) if Ottawa or Toronto is selected as the final destination by the winner. Prize also includes 2-nights’ double occupancy accommodation at a hotel pre-selected by VIA Rail Canada located in the city selected by the winner from the above choices and a pair of tickets to an NHL hockey game. A total approximate value of $2,500. Exact value of prize depends on point of departure as well as time of travel. The trip must be completed between January 1, 2013 and April 30, 2013 inclusive according to the NHL hockey game calendar. This prize does NOT include:

a) cost of travel to or from the origin train station;
b) parking at the train station, as the case may be;
c) lodging, food and beverages (except as provided on board, as included in the service class);
d) personal expenses; or,
e) any other expense not outlined specifically in the prize description.

The following conditions apply to the trip: No changes are permitted to reservations once they are completed, and winner and guest must travel together with the same itinerary.

8.1.1 Should the winner of this prize reside in the Montréal region, VIA Rail Canada reserves the right to substitute the value of the return trip transportation by train on board the Ocean from Halifax to Montréal in Sleeper class with a travel credit of equal value valid for travel anywhere on the VIA Rail Canada network. The travel credit will be valid from January 1st, 2013 to April 30, 2013.

8.2 Four (4) second prizes, each consisting of VIA Souvenir binoculars valued at $22.

26. Authorization. By accepting a prize, any entrant selected authorizes the Contest Organizers and their representatives to use, if required, his/her name, photo, likeness, voice, place of residence and/or statement regarding the prize for publicity purposes, without any form of compensation.

27. Communication with entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in these Contest Rules or at the Contest Organizers’ initiative. Persons submitting an NPER will only be contacted if the number assigned to their entry is found to match a lucky number.

28. Personal information. Entrants’ personal information collected for the purpose of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications.

29. Instant prize winner identification. For the purpose of these Contest Rules, the winner will be: in Sleeper class cabins, the person whose name appears on the ticket corresponding to the lucky cabin number unless that person is under 18 years of age and accompanied by a person 18 years and over in which case the prize will be remitted to the latter; if the cabin is occupied by two persons of legal age and in the event that these two persons cannot come to a mutual agreement on who shall accept the prize, the VIA Rail Canada Service Manager reserves the right to do a coin toss to determine the winner between these two persons; in Economy class cars, it will be the person who holds a valid ticket and legally occupies the seat corresponding to the lucky seat number at the time the VIA Rail representative approaches to award the prize unless again that person is under 18 years of age and accompanied by a person 18 years and over in which case the prize will be remitted to the latter; and in the case of an NPER, the winner will be the person identified therein.

30. Contest Organizers’ decision. Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal.

31. Litigation. Any question concerning the interpretation, validity and enforceability of the Contest Rules or of the rights and obligations of the participant and the Contest Organizers regarding the Contest will by subject to, and interpreted under, the laws of the province of Quebec, Canada. In case of litigation, such will have to be submitted to the courts in the Montréal judicial district.

32. Unenforceability. If a section of the Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

33. Language. In case of any discrepancy between the French and English versions of these Contest Rules, the French version shall prevail.
