You could win:

  • Round-trip train travel for two, in May 2011, from the station closest to the winner’s residence to Ottawa, in Business class (if available) and/or Sleeper class or Sleeper Touring class.

Contest rules and regulations

VIA Rail Canada Inc. is the Contest Holder for the VIA Rail “Canadian Tulip Festival in Ottawa” contest.

Conditions

The contest is open to all Canadian residents who have reached the age of majority in their province of residence at the time they enter this contest.

By entering this contest, each entrant agrees to, and is deemed to have accepted, all terms, conditions, rules and regulations set forth herein.

VIA Rail Canada Inc. agrees to abide by these terms, conditions, rules and regulations. All decisions by the contest managers are final.

Contest period

This contest begins at midnight (EDT) on June 2, 2010, and ends at 11:59 p.m. (EDT) on September 6, 2010.

How to enter

To be eligible to win the contest, contestants must provide their first and last names, as well as a valid e-mail address, civic address, and telephone number on the contest entry form before the contest end date.

The eligible winner will be required to answer a skill-testing question to win this contest.

Determination of winner

The draw will take place at VIA Rail headquarters, located at 3 Place Ville-Marie, 5th floor, Montréal, QC, H3B 2C9, on Wednesday, September 15, 2010 at 1:00 p.m.

The winner will be determined as follows:

  • On the day of the draw, a list of all qualifying entries will be compiled. Only one form per entrant will be allowed.
  • Software will then randomly shuffle the list. The person whose name appears at the top of the shuffled list will be considered the first selected contestant; the second name determines the second selected contestant, and so on.

Notification of winner

The first selected contestant will be contacted at the telephone numbers provided on his or her entry form. If the first selected contestant does not answer, a message will be left and the contestant will have 48 hours to contact the contest holder to claim the prize and be declared a winner. If the selected contestant fails to contact the contest holder within that timeframe, he or she will be automatically disqualified, and the next contestant will be contacted and must meet the same conditions to be declared a winner.

Prize description

A total of one (1) prize will be awarded to one winner. The prize includes:

  • Round-trip train travel for two, in May 2011, from the station closest to the winner’s residence to Ottawa, in Business class (if available) and/or Sleeper class or Sleeper Touring class.
  • Three (3) nights stay in a hotel in downtown Ottawa, courtesy of the Canadian Tulip Festival

Prize value: $9600.00.

This prize does not include:

  • cost of travel to or from the origin or destination train stations;
  • parking at train stations;
  • personal expenses;
  • alcoholic beverages (except when included in Business class); and,
  • any other expense not outlined specifically in prize description.

This prize must be accepted as is, and cannot be transferred, exchanged, cashed or returned for refund.

Delivery of prize

A representative appointed by VIA Rail will confirm the winner's address and the prize will be sent either by registered mail or by courier. The delivery method used will be decided upon by the representative appointed by VIA Rail and may depend on the prize itself.

The prize will be sent within seven (7) days after receipt of the release form signed by the winner (see next section).

Rights of use and limitation of liability

The contest winner must consent to the use, if necessary, of his or her name and photograph for contest-related advertising purposes with no compensation.

A refusal to accept the prize releases the Contest Holder of all obligations related to the prize.

The Contest Holder assumes no liability in all instances in which its incapacity to act is the result of a situation or fact beyond its control, particularly a strike, lockout or any other labour conflict on its premises or those of its partners supplying part of the prize, if such situation or fact affects the services required for this contest.

The Contest Holder assumes no liability for lost or late entries, mistakes on contestants' forms, misprints, errors of transmission or any other errors.

The contest winner must sign a release form confirming his or her eligibility for the contest (as specified under "Eligibility" below) and relieving the Contest Holder of any liability for damages or losses resulting from entering this contest or related to award and use of the prizes.

Province of Québec: any litigation respecting the conduct or organization of this contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Eligibility

Employees, suppliers and agents of VIA Rail Canada, as well as those residing in their households, are not eligible to enter the contest.

This contest is subject to all applicable federal, provincial and municipal laws. All entries received become the property of VIA Rail Canada Inc.
